LICENSE POLICY

By purchasing and downloading digital product materials from the Site, you agree to the following license terms depending on the type of product you purchase. When you purchase any type of digital product material from MusicAndTheory.com, you are granted a personal and non-exclusive license to utilize the material you purchase consistent with the one of the following license types:

Studio License

You, the Purchaser, are permitted to use the purchased digital PDF Materials with any number of your own students that you teach in real time as an individual teacher. You may share, reprint, and redistribute the purchased Material with this audience only, as many times as needed, for educational and non-commercial use. You may not otherwise reproduce, modify, distribute, transmit, post, or publish the Material without our prior written consent. Material in the form of sheet music may be performed by You or by one of your current students in recitals or other non-commercial public settings. 

This License and Material may not be shared with any other teachers in the same studio, teachers in different studios, or any other non-student individual or group. Such individuals will need to purchase their own Single User or Studio License. Students must purchase their own Materials in order to share with any family members, friends, or other individuals.

Ensemble Use License

You, the Purchaser, are permitted to use the purchased digital PDF Materials with the members selected to perform in your current ensemble. You may provide one copy for each individual member of the current ensemble as necessary for the intended performance. All copies must be returned to you after the performance. You are permitted to hold these copies in reserve with the original copy for additional later performances in which you take part.

This license and material may not be shared with any other individual or group, including other family members, church members, friends, or other individuals. Such individuals will need to purchase their own Single User or Ensemble Use License. 

Single User License

You, the Purchaser, are only permitted to use the purchased digital PDF Materials for or as a single individual for whom the Material was purchased. If you purchase for yourself, you are the sole owner of the Single User License. If you purchase on behalf of another individual, upon receipt of the Material this individual will become the sole owner of the Single User License, and You will not be permitted to retain any copy of the Material. 

The owner of the Single User License may retain one copy of the Material for personal, educational, or non-commercial use. If this original copy becomes lost, damaged, or destroyed, the individual may re-access the Material to produce a new copy; any remaining Material from the original copy must be destroyed beyond recognition. Any other reproduction or redistribution of the Material is strictly prohibited. You may not otherwise reproduce, modify, distribute, transmit, post, or publish the Material without our prior written consent. Material in the form of sheet music may be performed by the owner of the Single User license in recitals or other non-commercial public settings. No other use of the Material is authorized. 

This License and Material may not be shared with any other individual, teacher, fellow student, friend, family member, or any other non-student individual or group. Such individuals will need to purchase their own Single User, Studio License, or Ensemble Use License. 

Please Note:

YOU MAY NOT USE THE MATERIALS FOR ANY OTHER PURPOSES OR DISTRIBUTE THEM ELECTRONICALLY FOR ANY REASON. YOU MAY NOT DISTRIBUTE THE MATERIALS IN PRINT EXCEPT FOR THE PURPOSES DESCRIBED IN THIS AGREEMENT. WE MAY TERMINATE THIS LICENSE FOR PURCHASED MATERIALS “FOR CAUSE” IN THE EVENT THAT WE DETERMINE IN OUR SOLE DISCRETION THAT YOU HAVE BREACHED YOUR OBLIGATIONS UNDER THIS AGREEMENT.

You may not sell or re-sell any of the materials to anyone, including your students. However, to cover printing costs for Studio License items, you may charge your students a “printing fee” for the resource.

Upgrading Your License

If you have purchased a Single User License for a particular product and would like to upgrade to a Studio License or Ensemble Use License, we’re happy to do that for you! Contact us using the following form and we will issue you a unique coupon code for the amount of the Single User License you already purchased. When you go to purchase the Studio License or Ensemble Use License version, enter this coupon code in your Cart and the Product will be discounted so that you will only be charged the difference. You may upgrade your License at any time — even years after your original purchase! Please note that all upgrades to Studio Licenses and Ensemble Use Licenses are sold at their current rate; previous rates will not be recognized.

Example: You purchase Sheet Music with a Single User License for $3.99 and wish to upgrade to a Studio License that is $8.99. Complete the Form below to receive a unique coupon code in the amount of $3.99 to use for your license upgrade. Add the Studio License to your Cart and enter the coupon code provided to you, and the cost of your $8.99 Studio License will be discounted to $5. Complete the purchase, and you will now have a Studio License for this Sheet Music.
